Terms of Service
1. Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of Food Health: Scan & Score (the "App"), a mobile application provided by Eidogen-Sertanty, Inc. ("we," "us," "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
2. Description of Service
Food Health: Scan & Score is a mobile application that uses artificial intelligence to analyze photos of food and estimate nutritional information, provide health-related scoring, and allow users to optionally submit meal photos to a community "Showcase" feature. Approved Showcase submissions may be published to third-party platforms including Facebook, Instagram, YouTube, and TikTok on official Food Health: Scan & Score channels.
3. Eligibility
You must be at least 13 years old to use the App. If you are under the age of majority in your jurisdiction, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
4. User Accounts
Some features of Food Health: Scan & Score require you to register an account or use device-identifier-based authentication. You are responsible for safeguarding your account credentials and for any activity that occurs under your account.
5. User Content
By submitting a photo to the Showcase feature of Food Health: Scan & Score, you grant Eidogen-Sertanty, Inc. a worldwide, non-exclusive, royalty-free, sublicensable license to use, reproduce, modify, adapt, publish, and distribute that content in connection with the App and on our official social media channels, including TikTok, Instagram, Facebook, and YouTube. You represent that you own or have all necessary rights to any content you submit, and that the content does not violate any third party's rights or any applicable law. You may request removal of any Showcase submission by contacting support@eidogen-sertanty.com.
6. Prohibited Conduct
You agree not to: (a) use the App for any unlawful purpose; (b) submit content that is infringing, defamatory, obscene, or otherwise unlawful; (c) attempt to reverse engineer, decompile, or gain unauthorized access to the App or its backend services; (d) impersonate another person or misrepresent your identity; (e) use the App to harass, abuse, or harm others; or (f) use automated means (bots, scrapers) to interact with the App.
7. Intellectual Property
The App, including all software, designs, text, graphics, logos, and trademarks, is the property of Eidogen-Sertanty, Inc. and is protected by copyright, trademark, and other applicable laws. These Terms do not grant you any right to use our trademarks or branding.
8. Purchases and Credits
Food Health: Scan & Score offers in-app purchases, including credit packs consumed by scanning features. All purchases are processed by Apple (iOS) or Google (Android) under their respective platform terms. Credits are non-refundable except as required by law or platform policy, and have no cash value.
9. Health and Nutrition Disclaimer
Food Health: Scan & Score provides estimated nutritional information and health-related scores for informational purposes only. It is not intended as medical advice, diagnosis, or treatment. Do not rely on the App for clinical, dietary, or medical decisions. Consult a qualified healthcare professional for personalized advice.
10. Third-Party Services
The App integrates with third-party services including but not limited to Apple, Google, Meta (Facebook and Instagram), YouTube, and TikTok. Your use of those services is governed by their respective terms and privacy policies. We are not responsible for the availability or content of third-party services.
11. Disclaimer of Warranties
Food Health: Scan & Score is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including without limitation warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy of nutritional estimates.
12. Limitation of Liability
To the fullest extent permitted by applicable law, Eidogen-Sertanty, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of Food Health: Scan & Score. Our total liability under these Terms shall not exceed the amount you paid to us in the twelve (12) months preceding the claim, or USD $100, whichever is greater.
13. Termination
We may suspend or terminate your access to the App at any time for any reason, including if you violate these Terms. You may stop using the App at any time by uninstalling it.
14. Changes to These Terms
We may update these Terms from time to time. Material changes will be posted at https://foodhealthscan.com/terms.html with an updated "Last updated" date. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.
15. Governing Law
These Terms are governed by the laws of the State of California, United States, without regard to its conflict of laws principles. Any dispute arising from these Terms or your use of Food Health: Scan & Score shall be resolved exclusively in the state or federal courts located in San Diego County, California.
