These Terms of Service apply to the Food Health AI mobile applications and the website at foodhealthscan.com.
Acceptance of Terms
By downloading, accessing, or using Food Health AI, you agree to these Terms of Service. If you do not agree, do not use the app or website.
Who May Use the Service
You may use Food Health AI only if you can form a binding agreement under applicable law. The service is not directed to children under 13.
What the Service Does
Food Health AI helps users log meals, analyze nutrition, review trends, connect optional health data, and participate in optional community or challenge features.
- Food analysis results are generated from your submitted text, photos, and related inputs
- Results may include nutrition estimates, pattern analysis, summaries, and visualizations
- Some features may rely on third-party services, platform integrations, or external data sources
No Medical Advice
Food Health AI is an informational tool only. It does not provide medical advice, diagnosis, or treatment, and it is not a substitute for a physician, dietitian, or other licensed healthcare professional.
- Do not rely on the app for emergencies or urgent health decisions
- Always use your own judgment and consult a qualified professional when appropriate
- Nutrition estimates, AI outputs, and health correlations may be incomplete or inaccurate
Your Content and Responsibilities
You are responsible for the information, photos, notes, and other content you submit through the service.
- You must have the right to upload any content you submit
- You agree not to upload unlawful, infringing, abusive, deceptive, or harmful content
- You agree not to interfere with the service, attempt unauthorized access, reverse engineer restricted parts of the system, or misuse challenge and community features
Accounts, Credits, and Purchases
Some features may require an account, credits, platform purchases, or your own API credentials.
- In-app purchases are processed by Apple or Google, not by us directly
- Credits, subscriptions, and digital features may change over time
- You are responsible for charges incurred through your device account or your own API usage
- Refunds, if any, are handled according to the rules of the applicable app store or payment platform
Health Data and Integrations
If you connect Apple Health, Health Connect, location, camera, or similar device features, you grant the permissions needed for the app to perform the functions you choose to use.
Your use of those features remains subject to your device settings, the permissions you grant, and any applicable third-party platform rules.
Availability and Changes
We may update, suspend, limit, or discontinue any part of the service at any time, with or without notice.

Termination

Limitation of Liability
To the fullest extent permitted by law, Food Health AI and its operators will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, goodwill, or business interruption arising out of or related to your use of the service.
To the fullest extent permitted by law, our total liability for any claim relating to the service will not exceed the amount you paid us, if any, in the twelve months before the claim arose.
Indemnification
You agree to defend, indemnify, and hold harmless Food Health AI and its operators from claims, liabilities, damages, losses, and expenses arising from your misuse of the service, your content, or your violation of these Terms or applicable law.
Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except where applicable law requires otherwise.
